🧾 NEBULIVE – TERMS OF USE

1. Introduction

Welcome to Nebulive, an online platform operated by Printixel that allows users to generate AI-powered background images for streaming and creative purposes.
By creating an account or using the platform, you agree to these Terms of Use (“Terms”). If you do not agree, you must not access or use Nebulive.

2. Eligibility and Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Nebulive.
Accounts may be created using an email and password or through Google login.
You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

Users may delete their account at any time via the account settings or by contacting contact@nebulive.com.

3. Credits and Subscriptions

Upon registration, each user receives 5 free credits.

  • Free credits are not eligible for commercial use.
  • Additional credits can be purchased through Stripe.
  • Credits do not expire.
  • Once a credit has been used to generate an image, it cannot be refunded.

Nebulive also offers subscription plans that provide recurring credits or premium features. Subscriptions renew automatically unless canceled before the renewal date.

4. Image Generation and Use

Nebulive’s AI technology is designed exclusively for generating background visuals for streaming or content creation (e.g., YouTube, Twitch, Kick, etc.).
You may not use Nebulive to generate, distribute, or promote content that is illegal, defamatory, hateful, pornographic, violent, discriminatory, or otherwise inappropriate.

Generated images are intended for non-commercial use only, except for explicit exceptions granted by Printixel.
Nebulive is not responsible for the content generated by users, even though protections and filters are in place to limit misuse.

Images may be automatically deleted after a period of time. Users are responsible for saving any images locally if they wish to keep them.

5. Intellectual Property

All software, interfaces, graphics, and branding associated with Nebulive remain the property of Printixel.
You retain ownership of the prompts and any generated content, subject to these Terms and applicable laws.

You may not reverse engineer, copy, or reproduce Nebulive’s platform or code.

6. Payments and Refund Policy

All payments are processed securely via Stripe.
Refunds are not available once credits are used.
In case of payment issues or fraudulent activity, Printixel reserves the right to suspend or terminate accounts.

7. Service Availability and Disclaimer

Nebulive is provided “as is” and “as available.”
While Printixel strives for continuous uptime, it does not guarantee uninterrupted service or error-free operation.
Printixel is not liable for data loss, delays, or interruptions beyond its control.

8. Prohibited Activities

You agree not to use Nebulive to:

  • Generate realistic depictions of people without consent.
  • Produce deepfakes, explicit, political, or misleading content.
  • Circumvent credit systems, rate limits, or security measures.
  • Interfere with Nebulive’s servers or other users.

Violations may result in immediate account termination without refund.

9. Limitation of Liability

To the fullest extent permitted by law, Printixel shall not be liable for indirect, incidental, or consequential damages arising from your use of Nebulive, including but not limited to lost data, lost profits, or misuse of generated content.

10. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of France, under the jurisdiction of the Courts of Lyon.
However, Nebulive is made available globally in English, and these Terms may be translated for convenience.

11. Changes to These Terms

Printixel may update these Terms at any time. Users will be notified of significant changes via email or an in-app notice. Continued use after changes implies acceptance of the revised Terms.
